I have to respect the people of Holland and that nation. I think as one of them, you would know why as a Jew who's Great-Uncle had the tattoo on his arm would not say what I said about Amsterdam if it was a city in Holland. Get it. It is a well acknowledged fact that so many Dutch risked their lives to hide Jews from the Nazis. No other nation in Europe can make anywhere near the claim that Holland can about that. He for the moment has that option but time will eventually run out. My lawyer got the intitial disclosure from his ISP this morning. That they could fax to him, the postal address of Mike in Ca how he pays for the service including the account number, and the lawyer's staff will now type up the papers and start arranging to serve him. He still needs the date(s) he will hold the Deposition. Once we get to that stage only a large cash settlement will be acceptable to him and myself.

Understand he is the one that will have to travel here one time or more. He is required to be in the Deposition hearing *here* and if it still is not resolved and finalized, he will have to return for the court.

It is contempt charge time to not show at these times. It is in the Plaintif's jurixdiction that everything must be done. Deposition and court can run more than one day each. He has to pay room and board for himself and anyone else he brings along.

The court in Trenton (Mercer County of NJ Court) does not require he hire a lawyer. He can choose to defend himself. There is no 4th and 5th Ammedment in Civil Laws. He will have to testify. If he does not have a lawyer the only questioning will be my lawyer asking or the Judge. He cannot testify for himself without the structure of someone else asking questions of him. Thus there is an old addage, "Any Lawyer that has himself as a client, has a fool as a Client.

Ca BAR association members to be the attorney of record (the one to "examine" the witness) has to be licensed by The NJ BAR Association. They do not unless it is a lawyer of a lot of renound (such as Kunsler and a select few others) get any temporary certification. They have to come to one of the states NJ Courts and the BAR automatically recognize the members to be pre-certified. All others must actually take the BAR Exam here in one of the states (I posted them already in another post).

I do not know when the BAR Exam can be taken in any state except NJ. Here they will *only* give the test 4 times a year and never on any date that was not scheduled for the year. He missed one of them recently so if the court moves as quickly as they did in Hearing my case against Howard Aubrey, the lawer he hires in Ca may only be allowed to co-council that day in court.

Answer: Sorry about the obvious mistake. The original libelous statement came from a poster from Amsterdam (confirmed by the IP address and who assigned the IP to the ISP he is with). Now what I said about the town was cruel, however it does not meet the definition of Libel. According to documentries and FBI reports on Porn on the Internet and Local Law enforcement that try to trap preditors on the net (all on Documentries done by news reporters) Amsterdam is one of the largest source of many forms of Porn on the Net and that inludes persons portraid as in early teens or even younger. I can stand up to that statement in court. I never said you ran such or ever visited such. SO to this moneker I never Libeled you.

For a statement to be actionable under Libel it must be unable by the one that wrote it, published it or said it where other persons would be assumed to read or hear it, as true. I.e., it was plainly posted here that I was on Parole. Definition of Parole is about an early release from a prison. That means he said I served time in a prison. He must be able to prove that in court as true. He cannot as I never did. Under the Libel Laws I only have to present what he posted and my evidence that is the person that posted it or from his account published it. All other burden of proof is on the one that made the statement. I filed my action and now I do nothing till the Deposition Date. I as a human being offered him a way out. If he takes it is over, done with, it does not cost him any money other than his time to do it. He does not even have to appologize. All he has to do is a retraction post. That is not an admission of guilt BTW, it is just that he is acknowledging there is no evidence to support his statements so he wants to retract them.

Libel does apply to websites as well as the Press. It is puting the statement out where others are assumed to see it and not being able to prove in a court of law that the statement was the absolute truth. You can look and see what I did to Howard Aubrey for his two statements that he thought he could not be sued for because it was in a website. The Judgement was for over $750,000 (Seven Hundred and Fifty Thousand dollars).

He thought that avaiding the serving of the papers would relieve him from the court case. All that meant is that the Judge only heard my evidence and my testimony. There was no defence raised because he avaided the notices that he had to appear. There is a Bench Warant for his not showing up for the Depositon meetings that were under a court order to attend. I was there as was my lawyer. When no one showed up for his part, My attorney had no option, Lawyers are "Officers of the Court" so he had to report that no one showed up. The Judge issued a bench warrant. Now the odds of him ever being arrested for it a very slim. It can only happen if he is in NJ and has to show his ID to a Police person or a Judge. They run a check for outsanding warrants and that is the only ways he will be held accountable for that warrant. A bench warrent is a "Contempt of Court" charge. The Judge is Judge, and Jury on it and usually the one if possible that issued it. Contempt of court (I saw someone sentenced for that one last time I was there for a minor traffic ticket that I wanted to fight and I won that one - obscured first trafic speed sign for the town I got for going 6 miles over the limit) He got a $1,000 dollar fine and 10 days in the County Facility (work house). He was allowed to go to home all the week days and serve the time on 5 weekends as he was not paid salery but for hours worked and was the sole support of his family. There is some compassion at times by the Judges here. But it is based on their impression of the person and any evidence provided. That day for the speeding ticket, I pled not guilty. I presented several photographs as a car would approach the only speed limit sign where it was lowered with no wanring of "reduced speed ahead". The sign was not visable at any time above the pole that held it. There was a very leaf full branch and a second branch blocking it from view. I went to court prepared and won. The township had to eat the court fee as well because I won. The Branch btw was in contact with the sign so even when you were right up to it, it was still not legally there.
